There is one Magistrate Court in Bamberg County with one full time and one part time judge. Generally, Magistrates have criminal jurisdiction over offenses punishable by up to $500 fines and 30 days in jail. Magistrates also have civil jurisdiction over cases involving damages of $7500 and below.
All Magistrates are appointed by the Governor with the advice and consent of the Senate, to serve four year terms. South Carolina Court Administration provides administrative support to the Magistrate Courts.
All defendants have a right to a jury trial when requested. One must direct a jury trial request to the Magistrate that is scheduled to hear the case. Each court has a scheduled time to conduct jury trials and will contact all parties involved as to the date and time of their jury selection and trial.
Children are not allowed in court unless they are old enough to sit still and be quiet. You must wear shirt and shoes in the courtroom. No shorts above the knee. No Cell Phones or radios are allowed. Related Link: SC Judicial Department The Court does not accept payments after 4:30 p.m. Bond Hearings are scheduled daily at 9:30 a.m. and 3:30 p.m.
